Vacant Property Inspection (VPI) Service Disclaimer

By engaging the services of Thanet Vacant Property Inspections (“the Company”), the Client acknowledges and agrees that they have read, understand, and accept the terms of this Disclaimer, as well as the Company’s full Trading Conditions.

This disclaimer outlines the scope and limitations of the inspection services provided by the Company.

  1. Scope and Limitation of Services

The Company’s Vacant Property Inspection (VPI) service is a visual check conducted at defined intervals and documented via a written report.

  • Non-Security Guarantee: The VPI is not a guarantee against theft, vandalism, fire, water damage, or any other loss. The Company provides a monitoring and reporting service only; it does not replace or supersede a dedicated alarm system, insurance policy, or the need for professional security patrols.
  • Time Limitation: The inspection reflects the condition of the property only at the exact moment the inspection is carried out. The Company accepts no responsibility for any incident, damage, or loss occurring before the inspection, immediately following the inspection, or during the interval between scheduled inspections.
  • Reasonable Endeavours: The Company undertakes to use reasonable skill and care to carry out the agreed-upon inspection checklist. However, the Company accepts no liability for items that may be missed, including, but not limited to, checking or reporting on the security status of every single door or window. The inspection is based on a visual overview.
  1. Exclusion of Liability for Third-Party Action

The Company shall not be liable for any loss, damage, or injury, financial or otherwise, resulting from the criminal or negligent acts of any third party, including:

  • Break-Ins and Theft: The Company is expressly not responsible for any losses sustained due to a break-in, theft, or trespass that occurs after the inspection is complete.
  • Security Failures: The discovery of any previous security breach (e.g., an unlocked window or door) and its subsequent reporting by the Company does not transfer liability for that breach or any ensuing loss to the Company.
  1. Client Responsibility

By engaging the Company for VPI services, the Client acknowledges and accepts the following responsibilities:

  • Adequate Insurance: It remains the sole responsibility of the Client to maintain adequate property insurance to cover all potential risks, including but not limited to fire, flood, theft, and vandalism.
  • Prompt Action: The Client must act promptly upon receipt of the Company’s VPI report to rectify any faults, damages, or breaches identified therein. The Company accepts no liability for losses that occur due to the Client’s failure to take timely action on a reported issue.
  1. Indemnity and Claims

The Client agrees to indemnify and hold the Company harmless against all claims, liabilities, and costs arising out of any loss or damage to the property, except where such loss is directly and solely caused by the gross negligence or wilful misconduct of the Company. In the event of a valid claim, the Company’s liability will be strictly limited to the level of indemnity provided by the Company’s Public Liability Insurance policy.
